CASE OVERVIEW

Kohn, Swift & Graf is lead counsel in this multidistrict litigation alleging a conspiracy to allocate customers and territories in the U.S. for Packaged Ice in violation of the Section 1 of the Sherman Antitrust Act, 15 U.S.C. § 1. “Packaged Ice” is ice packaged in bags and also ice sold in blocks. The case is brought on behalf of a class defined as: “All purchasers of Packaged Ice who purchased Packaged Ice in the United States directly from any of the Defendants or their subsidiaries or affiliates at any time during the period from January 1, 2001 to March 6, 2008.”

The Defendants are Reddy Ice Holdings, Inc., Reddy Ice Corporation, Arctic Glacier Income Fund, Arctic Glacier, Inc. and The Home City Ice Company. Plaintiffs allege that the Defendants agreed not to compete for each other’s customers and in each other’s territories, thereby causing the prices for Packaged Ice to be artificially inflated. Defendant Home City Ice Company has pleaded guilty to violating the Sherman Act. The case is pending in the United States District Court for the Eastern District of Michigan before the Honorable Paul D. Borman.
