Kohn Swift is pursuing data security breach litigation to recover damages for the victims of the OPM (Office of Personnel Management) data breach. Personal information taken included social security numbers, fingerprints, and other sensitive data. This litigation resulted in opinions from the district court regarding standing for plaintiffs bringing actions against defendants for data breaches.

On August 7, 2015, Kohn Swift filed a proposed class action lawsuit in the United States District Court for the District of Colorado against the Office of Personnel Management (“OPM”), KeyPoint Government Solutions, and the Department of Homeland Security (“DHS”), alleging that their negligence led to a data breach that compromised the personal information of approximately 21.5 million current, former and prospective government employees and contractors.

The case is captioned: McGarry v. Office of Personnel Management et al., Case No. 1:15-cv-01705, and is pending in the United States District Court for the District of Colorado.
