Plaintiff Nancy J. Becker, in her official capacity as the Recorder of Deeds of Montgomery County, Pennsylvania, brought this class action on behalf of all Pennsylvania County Recorders of Deeds against MERSCORP, Inc. and Mortgage Electronic Registration Systems, Inc. (the “MERS Defendants”). The case is pending in the United States District Court for the Eastern District of Pennsylvania before the Honorable J. Curtis Joyner.  Kohn, Swift & Graf, P.C. has been appointed as one of the lead counsel firms for the class.

The complaint alleges that the MERS Defendants violated Pennsylvania law by failing to record certain mortgage assignments as required by 21 P.S. § 351 and that, as a result, the land records of Pennsylvania are imcomplete and the Recorders of Deeds in Pennsylvania have been deprived of the recording fees that would have been paid had the mortgage asignments been recorded as required.

On February 12, 2014, the Court certified a class of “Each County Recorder of Deeds in Pennsylvania in his or her offical capacity” with respect to Plaintiff’s claims to quiet title and for injunctive and declaratory relief.
