Kohn, Swift & Graf, along with co-counsel, Marcus & Mack, represent consumers in cases against energy companies that re-sell energy and gas to consumers. The Firm represents Amy Silvis in a  class action against Ambit Northeast, LLC (“Ambit”) alleging that Ambit’s pricing of its variable-rate electricity plan breached her contract. The District Court’s order granted summary judgment in favor of Ambit.

Several months ago, the United States Court of Appeals for the Third Circuit filed an opinion vacating the summary judgment ruling passed down by the District Court in AMY SILVIS, ON BEHALF OF HERSELF AND ALL OTHERS SIMILARLY SITUATED, v. AMBIT ENERGY L.P and remanded the case back to the District Court for further proceedings. The Third Circuit cited the ambiguity of the contract as to the limitations of Ambit’s pricing discretion as the reason for their decision.
