However, energy service company, Consumers Energy, is stepping up random calling to homeowners. Even though, the company clearly knows that their telephone solicitations are illegal when used in tandem with automated telephone equipment.

Their actions could amount to TCPA (Telephone Consumer Protection Act) violations. The TCPA restricts telephone solicitations and limits the use of automatic dialing systems and prerecorded voice messages. Usually, a short pause at the beginning of the call is a sure sign that call is being made by an auto-dialer, which is in violation of TCPA.
