April 1, 2019- Kohn, Swift, & Graf, P.C., has filed a lawsuit against 3M Company and Aearo Technologies, LLC for manufacturing and selling defective dual-ended Combat ArmsTM Earplugs.
Faulty Earplugs were knowingly sold to US Military causes hearing loss to many vets
Aearo Technologies, a self-proclaimed “global market leader in hearing and eye protection,” developed, marketed, and sold Combat ArmsTM Earplugs to the United States Army. In 2008, the company was acquired by 3M. However, neither company disclosed that the earplugs were defective. The earplugs gradually loosened in the wearer’s ear, allowing sounds to enter the ear canal and damage the wearer’s eardrum.
Filed in the Eastern District of Pennsylvania, the federal lawsuit alleges that Aearo Technologies and 3M falsified test results to hide the defective nature of the earplugs, despite its multi-million dollar contract with the United States Army. Because the defect was imperceptible to the wearer, Defendants’ design defect went undetected for more than a decade by the U.S. military and those who wore them.
Defendant’s misrepresentations about the benefits and protections provided by the Combat ArmsTM Earplugs have caused United States veterans to suffer tinnitus and/or hearing loss.
