KOHN SWIFT INVESTIGATES AMAZON FOR ANTICOMPETITIVE CONDUCT IN THE E-BOOK MARKET
Kohn, Swift & Graf is investigating Amazon for anticompetitive behavior in connection with e-book sales. It has recently been alleged that Amazon entered into agreements with 5 large book publishers in order to fix prices for e-books at a level higher than what they would have been in the absence of Amazon’s competitive restraints.
It is alleged that Amazon agreed with the publishers on a “Most Favored Nation” (MFN) clause, which prohibited the publishers from selling books anywhere for a lower price than what is offered on Amazon. The complaint also alleges that Amazon’s approximate 90% share of the e-book market has given it unfair leverage to make and enforce such agreements, causing damages to consumers.
