District Court Certifies Earlier Order, Agrees with Plaintiffs that Appeal in Scientology Case is Warranted
On June 7, 2023, Judge Thomas P. Barber of the U.S. District Court for the Middle District of Florida granted Plaintiffs’ Motion to Certify the Court’s March 31, 2023 Order for Interlocutory Appeal Under 28 U.S.C. § 1292(b).
Kohn Swift will now formally petition the Eleventh Circuit Court of Appeals to accept their appeal from the order, which directed the Plaintiffs into arbitration, based on two issues: (1) whether the District Court should rule on certain contract formulation issues in the first instance, rather than leave that for Scientology arbitrators to decide, and (2) whether forcing Plaintiffs into this arbitration process with Scientology violates their First Amendment right to leave a religion.
