In the News: KS&G Class Action Lawsuit Against Bucks County and Bucks County Correctional Facility
Two highly regarded news sources picked up the important work we are doing.
The class action suit involves a Pennsylvania county jail posting a mugshot, and other personal information, of Plaintiff Daryoush Taha on their website two years after charges were dropped. “Respect for one’s privacy is one of the tenets of this firm, so we are happy that this case is getting the notoriety it deserves,” says KS&G shareholder, Jonathan Shub.
Both Fox 29 News and AP (via The New York Times) reported on the status of the case:
A federal district court certified a class of around 68,000 former inmates whose personal information was posted online in violation of the Pennsylvania Criminal History Records Information Act (“CHRIA”). The county appealed to the Third Circuit. The Third Circuit affirmed the District Court’s order granting class action certification. More information on the Third Circuit’s ruling can be found here.
Because Bucks County has been found to be in violation of CHRIA, they could be on the hook for $1,000-$10,000 in punitive damages for each person whose picture was posted on the website. Those damages could range from between $68 million and $680 million.
