October 7, 2019- Last Friday, Judge Wendy Beetlestone of the Eastern District of Pennsylvania denied Bucks County’s post-trial motions in the landmark class action trial for violation of Pennsylvania’s Criminal History Records Information Act (CHRIA).

The judge’s decision came after attorneys for Bucks County filed motions for a new trial, suggesting that, during a May 2019 trial, the District Court had committed several errors, including in its instructions to the jury and in its admission of certain types of evidence. 

Denying the defendants’ motions, Judge Beetlestone found that Pennsylvania law supported a finding that the defendants had willfully violated the Criminal History Record Information Act, and that the jury had properly interpreted the statute in coming to its May 2019 verdict, which awarded $1,000 to each inmate whose privacy rights had been violated.

Defendants have appealed Judge Beetlestone’s decisions to the Bucks County’s Third Circuit, where the case is pending.
